What this agreement covers
JTWDBW LLC operates Tony AI and the website at www.tonyai.org. Our address is 335 S 100 W, Logan, UT 84321-5236, United States, and our contact email is support@tonyai.org. In this agreement, “we” and “us” refer to that company. “You” means the person using the website, app or related assistance. These terms cover those services and the creative functions supplied through the app.
The four creative features are image-to-video, video templates, AI images and image templates. The Android app is coming soon and has not been released. There is no current Google Play download link on this website. The site introduces the product and provides policies and support information; it is not a place to submit generation requests or make payments.
Conditions for a particular feature or purchase may explain its benefits and limits in more detail. They will be presented in the relevant app or purchase flow and should be read with these terms. A future feature description does not establish present availability. Neither these general terms nor a later website revision removes a legally binding promise made for an earlier purchase.
Reviewing and accepting the conditions
Take the opportunity to read the conditions relevant to a feature before using it, and to a purchase before authorising payment. When an acceptance step is presented, the agreement concerns the conditions supplied for that step. If you do not accept them, do not continue with the affected action. You may ask support to explain a term before deciding whether to proceed.
Accepting service terms does not give us an unrestricted permission over your information. It does not authorise AI training with user data, public disclosure of private inputs or a use that requires a separate legal basis or consent. Any consent, request or acknowledgment required independently by consumer or privacy law remains separate. A right that cannot lawfully be waived is not waived by acceptance.
Keep the relevant offer description and confirmation if you need to refer to the agreement later. A receipt is useful evidence of a transaction, but legally binding information provided before payment can also form part of the purchase. You do not have to accept an unrelated new condition merely to question an earlier charge, seek a remedy or exercise a privacy right.

The rights attached to your creative work
You retain the rights you already have in submitted images, videos, prompts, settings and other material. Before submitting anything, make sure the intended processing is permitted. Copyright, privacy, confidentiality, trademark and likeness rights may all matter. Having a copy of an image does not necessarily mean you can create a new depiction of the person in it or publish the result in any context.
We do not acquire ownership of your input merely by processing it, or claim ownership of an output solely because Tony AI produced it. That statement does not resolve rights belonging to someone else or rights that depend on local law. AI-generated work may lack copyright protection, resemble other work or be available in similar form to another user. We cannot guarantee exclusivity or unrestricted commercial use.
A supplied template or other licensed element may have disclosed conditions for its use. Consider those conditions, the complete result and your publication plans together. Review a result before saving, sharing or relying on it. Completion of a request does not certify that its content is accurate, lawful or cleared of third-party rights.
When sharing generated media, do not falsely present it as evidence of an actual event, a person's conduct or their approval. Make synthetic-content disclosures required by law, by the destination platform or by the context. Permission to use someone's photograph is not automatically permission to imply that they endorsed a message or participated in a fabricated scene.
The limited permission needed to fulfil a request
Submitting material gives us a non-exclusive permission to handle it as needed to receive your request, carry out the processing, temporarily store and transmit the material, and return the result. We may also handle it for a related support or safety matter you raise. This permission is limited by the service purpose and the deletion rules below; it is not a transfer of ownership or an unrestricted publication licence.
Our AI generation systems are self-hosted. Creative inputs and outputs are not sent to a third-party AI generation provider. We do not use any user data to train AI models, including inputs, results, prompts, support exchanges, payment information or other service records. We also do not carry out facial recognition or extract biometric information to identify people.
Material associated with a creation is deleted within 36 hours from upload start, or from submission of the prompt if the request has no upload. Outputs and associated records inherit that original deadline. Generation finishing later does not give the result a new retention period. Support activity, a report, a failed request or a service interruption does not restart or extend the deadline either.
We can consider a general improvement suggestion you voluntarily send without a payment becoming due simply because it was submitted. Feedback does not grant rights in unrelated work, authorise disclosure of private material or make an exception to the no-training rule. Do not include another person's confidential information in an unsolicited suggestion. Export creative results you need while available; the service is not a permanent archive.

Automatic deletion and your removal requests
The 36-hour limit covers all creation information: source and generated images and videos, prompts, parameters, settings, template choices, task identifiers, task status, timestamps, metadata and associations. It applies across every system we control and every processor acting for us. Copies in logs, support messages or reports and their attachments, caches and backups are included. Deleting only the finished media would not meet this commitment.
You can request deletion of Tony AI user data using Personal Settings or by emailing support@tonyai.org. These are independent routes: using one is not a prerequisite for the other. Email is available even if the app is inaccessible or uninstalled. You do not need a Tony AI registration or login. We may ask for limited details to find the relevant records and establish that the request is authorised.
Some independent records may be necessary for accounting, payment disputes, security, fraud prevention or a legal obligation, as described in the Privacy Policy. Such retention cannot keep creation content, details, metadata or links beyond the original creation deadline. It cannot preserve an indirect association with a creation, create an exception for a backup or report, or continue ordinary use of app-user records that should be removed.
Save a separate copy of a result you want before it is deleted. Erasure cannot recover material already removed or delete files you exported to your device or shared with another service. Removing Tony AI information does not remove your Google account or automatically request a purchase refund. You can pursue a purchase issue and a privacy request at the same time without completing one before the other.

Selecting photos and respecting private information
The Privacy Policy describes information handling for the app and website, including purposes, legal grounds, disclosures, safeguards, retention and available rights. The AI Data Privacy page concentrates on creation data. These notices should be read alongside the agreement. Merely referring to them here does not supply a consent or prevent you from using a right provided by privacy law.
Source images are selected through Android's system Photo Picker. Choose the images needed for the request and avoid unnecessary sensitive or confidential details. A face in a photo may still be personal information even though Tony AI does not recognise the person or extract a biometric identity. Consider the other people depicted and the permissions needed to transform or later publish their image.
We handle private material for the purposes described in the notices, including necessary operational processing and lawful disclosure obligations. Uploading a source image does not ask us to publish it for other users. Information is not made available for unrelated marketing or AI training through acceptance of these terms. A copy you later send to another service is separately subject to your choices and that service's own practices.

Variable results and required service standards
AI generation can produce mistakes, visual irregularities, unwanted details or material resembling another work. Running a similar request again can produce a different outcome. A prompt or selected template is not a guarantee of a precise appearance, factual accuracy, originality, exclusivity or fitness for every proposed publication. Inspect the result rather than relying only on the instruction you supplied.
The twelve original concept artworks on this website were created to illustrate creative directions. They are not Tony AI outputs, app screenshots or templates currently available inside the app. They do not promise that a request will reproduce the same composition or quality. Information about a feature actually available in the app, together with its purchase conditions, should guide a decision to use or buy it.
Variability does not cancel standards imposed by law. Applicable requirements that digital content match its description and meet required quality or conformity standards remain effective. So do requirements to provide services with reasonable care and skill. Where correction, repeat performance, a price reduction or a refund is legally required, describing a tool as generative is not a reason to deny that remedy or disregard an unfulfilled commitment.
App access without a sign-in
Tony AI does not require registration or login. An installation can nevertheless have identifiers and service records used to handle requests and associated benefits. They are distinct from a registered user account. A Google account used to obtain an app or complete a Google Play transaction belongs to Google's separate service; it is not a Tony AI account.
Use reasonable care with the device, app and payment access under your control. Contact support if you suspect unauthorised use of associated app records or paid access. Clearing local data, reinstalling or changing devices may affect local files and the references available to identify earlier use. Retain exported results and purchase confirmations that matter to you instead of assuming those actions will recover a lost benefit.
Describe support problems accurately and provide correct available references. If you do not know a detail, explain that rather than guessing. This concerns the information needed to investigate an issue, not the imaginative subject of a prompt. You can seek help without creating a Tony AI login, and an enquiry does not require disclosure of your store password, verification codes or complete payment-card details.

Installing and using an authorised app copy
When an authorised release becomes available, these terms permit you to install and use an authorised copy on a compatible device you own or control, in accordance with the applicable marketplace rules. The permission is limited and non-exclusive. It does not let you sublicense, rent, repackage or redistribute the app as a separate offering.
Do not sell, modify or distribute protected software components without permission, or remove their security and ownership notices. An exception granted by mandatory law or a separate component licence remains available within its scope. Permission concerning one component does not authorise access to other protected systems or disruption of the service.
Device capabilities, operating-system support, connectivity and relevant Google Play requirements can affect use. Your connection provider's charges are your responsibility. An available release may specify technical requirements, and updates may be needed for security or compatibility. We do not promise permanent compatibility with every device. Any change affecting an accepted paid obligation must still respect the purchase conditions and applicable consumer protections.
Software, branding and other service materials
The software, models, interface, documentation, brand and other protected materials supplied with Tony AI have rights separate from the content you submit. Those rights belong to us or the relevant licensors. Using a creative feature gives permission to use its functionality under the applicable conditions, not ownership of the technology, design or trademarks behind it.
Without permission or an applicable legal exception, do not reproduce, distribute, sell, license or commercially exploit protected service materials as your own product. Preserve copyright and ownership notices. Do not use our name or visual identity to suggest an endorsement, association or approval that we have not provided. A link to the website does not grant a licence to reproduce all of its material.
These restrictions do not themselves prevent a permitted export or publication of your own creative result. Mandatory exceptions and the terms of a separately licensed component continue to apply. If you are unsure whether a proposed reuse of Tony AI materials is allowed, provide enough detail for support to understand the request before relying on a permission that has not been given.
Limits that protect people and the service
Do not use Tony AI to violate the law, infringe another person's rights or harm people. These restrictions apply to inputs, generated results and the way you access the service. A request being technically accepted does not make its purpose permitted. In particular, the service must not be used for:
- Child sexual abuse or exploitation, sexualised depictions of minors, sexual exploitation, pornography intended for sexual gratification, or non-consensual intimate imagery, including fabricated imagery.
- Threats, harassment, hateful abuse, violent extremism, encouragement of self-harm or content promoting serious harm to people.
- Scams, phishing, fraud, deceptive impersonation, identity abuse, fabricated evidence or documents, or deliberate deception about civic processes.
- Violation of copyright, trademarks, privacy, publicity, likeness or other protected rights, or exposure of private information without a lawful basis.
- Malware, unauthorised access or security testing, deliberate overload, disruption of infrastructure or interference with another person's use.
- Manipulation of payment or entitlement records, avoidance of purchase controls or usage limits, evasion of safety restrictions, or resale of access without authorisation.
- Scraping or systematic extraction of protected service information, removal of proprietary notices or reverse engineering of protected software or non-public systems, except where law or a component licence permits it.
A concerning result can be reported using the report option on its creation-detail page, without leaving the app. You can also email support, including when you cannot open the app. Explain the concern and use an available reference instead of transmitting illegal material or unnecessary private details. Creation information in the report and attachments remains subject to its original deletion deadline.

Handling rights complaints and related responsibility
If material you submit or publish prompts a copyright, privacy, likeness or other rights complaint, you are responsible for your own unlawful conduct and liabilities assigned to you by law. We may ask for relevant information or evidence of permission to understand the complaint and protect affected people. Explain your connection to the material and avoid sending unnecessary private information.
A valid third-party claim caused by your deliberate unlawful conduct or material breach may give us a right to recover losses from you, but only to the extent applicable law permits. This is not an unlimited obligation to defend us or reimburse every claim connected with the service. Loss caused by our own breach, negligence or wrongdoing is not transferred to you by this provision.
An accusation is not conclusive evidence that an infringement occurred. Contact support if you believe a restriction or assessment is mistaken, and explain the grounds for your concern. A good-faith challenge is not itself abuse. Handling a complaint does not allow creation content, metadata, task records or links to survive their deadline in a case file, attachment or independently retained record.

No subscriptions and checking payment status
Tony AI has no subscriptions or automatic renewal. Each purchase requires your authorisation for the offer presented. Accepting these terms or completing an earlier transaction does not authorise an unrelated payment. An accepted offer remains subject to the conditions applicable when it was purchased; a later website statement cannot retrospectively replace them with less favourable conditions.
A pending payment, an unsuccessful attempt and a completed purchase need different checks. If payment completed but the benefit is missing, contact support with the order reference you have and a description of what is missing. No Tony AI registration is needed. Any information requested to match the transaction should be proportionate and must not include access to your Google account.
Do not assume repeated purchase attempts will fix a delivery failure. If you see duplicate charges for an intended single purchase, identify the relevant transactions so the issue can be reviewed. Removing the app or clearing device data is not a refund request. We must still supply the agreed benefit or the appropriate remedy; payment verification is not a reason to retain money for an unresolved failure to deliver.
See alsoPayment problems
Refunds, reversals and paid access
The Refund Policy explains help for duplicate or unauthorised charges, missing paid access, failed paid functions and other purchase issues. Google Play also offers refund and unauthorised-charge routes for transactions handled through its system. Which remedy is available depends on the transaction, circumstances, applicable store rules and law. There is neither a blanket ban on digital refunds nor a promise that every request will qualify.
We honour an approved Google Play refund or payment reversal and update the associated Tony AI entitlement to match. This can require correcting or withdrawing the benefit supplied by the refunded transaction. Adjustments should concern that purchase and respect the confirmed decision; unrelated valid purchases do not automatically disappear. Tell support if the app's access and the confirmed transaction outcome differ.
The store and payment provider control parts of returning a payment, so status and timing depend on the order and payment route. A statutory claim may remain available beyond the store's ordinary discretionary refund period. We can investigate credible manipulation or refund abuse proportionately, but seeking a legitimate refund or challenging an error does not constitute abuse or surrender another consumer right.
See alsoRefund Policy
Rights preserved wherever they apply
Mandatory consumer law may protect information before purchase, quality, conformity, warranties, cancellation and refunds. The rules relevant to your location and transaction take priority over conflicting terms. A store's policy can offer an additional route, but cannot reduce a statutory protection. The company's address does not by itself exclude rights available to consumers in another place.
If a statutory withdrawal or cancellation period applies, early supply of digital content or services must follow that law's requirements. These may include information, an express request, consent or acknowledgment concerning delivery and its effect on cancellation. Simply reading this website, viewing concept artwork or accepting general service conditions does not alone waive such a right. The required choices belong in the relevant purchase process.
When something is faulty, misdescribed or not delivered as agreed, the law may require correction, repeat performance, a price reduction, termination of the affected arrangement or a refund. Those protections must be considered even when an ordinary store refund window has ended. Explain the defect or missing benefit through support or another available process; a general disclaimer about AI cannot decide the outcome of every individual claim.

Our responsibility and your independent decisions
We are accountable for losses for which applicable law makes us responsible, including failure to perform our contractual obligations. These terms do not exclude or limit liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. All provisions about limitations must be read subject to those rules.
Consumer responsibility for loss is assessed under the relevant legal tests, including causation and reasonable foreseeability where applicable. References to variable output or interruptions do not excuse failure to supply an agreed service or remove a valid claim. We remain responsible where our conduct contributed to a loss; calling something an external problem or a user decision cannot erase that contribution.
You make your own decisions about publishing or relying on a result. Reasonable precautions include inspecting it, obtaining permissions and preserving exports you need. We do not automatically bear loss caused solely by misuse beyond our responsibility. That statement does not transfer our own duties to you or bar recovery that the law allows when both your choices and our conduct are relevant.
No promise is made that use will generate revenue, profits, audience growth or another commercial outcome. Business use is subject to that absence of a promised outcome, any specific agreement and mandatory law. It does not remove an accepted delivery obligation or alter the rights you hold in your work.
Maintenance, updates and changed features
Operation can be affected by maintenance, security work, compatibility updates, marketplace requirements or legal obligations. Network failures and events outside our reasonable control can also interrupt access. We do not promise uninterrupted availability, a fixed generation time or support for every device and operating-system version. A specific commitment in an accepted offer remains subject to its terms and applicable law.
Features may be improved, revised or discontinued for legitimate product or operational reasons. If a change materially affects an existing paid benefit, we will provide the notice and options required by the purchase conditions and the law. An urgent protective or legal measure may need to take effect before notice can be given, without removing a remedy that is otherwise due.
Where a change or withdrawal prevents us from providing what you purchased, the issue must be addressed. Appropriate action can include restoring the benefit, ending the affected arrangement or providing a refund where required. Contact support with the relevant purchase information. A right to develop the service does not permit keeping payment for an unfulfilled obligation, and operational changes do not alter the creation-data deadline.
Stopping use and decisions about access
You can choose to stop using Tony AI. We may reject a request, limit access or suspend or end use where reasonably necessary to address a serious breach, fraud, a security threat, a legal requirement or non-payment for the affected entitlement. A measure should respond proportionately to the issue and should not automatically remove unrelated valid rights.
Where appropriate and legally permitted, we will explain a restriction and provide a way to ask support to review a mistake. Urgent measures can precede notice, and some details may be withheld when disclosure would compromise security or violate law. Exercising a privacy right, making a legitimate refund request or raising a good-faith complaint is not itself grounds for punishment.
If permission to access a service ends, stop using it and do not bypass the restriction. Obligations relating to existing purchases, rights in material, lawful independent records and unresolved claims continue where their purpose requires. Termination does not erase a consumer remedy or privacy right, extend creation retention, or permit publication of private content or training on user information.

Other providers involved in the experience
Google Play may provide distribution and payment services, while other operational providers can assist with hosting or communications. Adjust is used only to attribute installation sources through necessary technical information. We do not send creation data, support communications, content reports or purchase events to Adjust. Our Privacy Policy explains the relevant processing and the choices available to you.
These operational functions are separate from self-hosted AI generation. Website delivery, payment handling or installation attribution does not involve forwarding your creative request to a third-party AI generation provider. Using a provider also does not displace our own responsibilities for the service, consumer commitments or information handled on our behalf.
External sites and stores control their own content, availability, decisions and notices. Their terms and privacy practices may differ from ours, and a link does not endorse every statement they publish. If an external offer or promotion is displayed, check who supplies it and what conditions apply. That supplier is responsible for its commitments unless we expressly undertake an obligation; our own statements remain subject to applicable law.
A reference to possible offers does not establish that a promotion is currently available. Following a link or participating in an offer does not require consent to unrelated marketing or optional tracking. If our description and an external supplier's conditions appear inconsistent, raise the discrepancy before relying on a benefit that may not be included.
Lawful access across borders
Export controls, sanctions and other applicable trade restrictions must be respected when accessing or transferring software or services. Do not complete a prohibited transaction or make access available to a person or destination that cannot lawfully receive it. The fact that a website or app can be reached technically is not evidence that every proposed use is legally authorised.
We may restrict access when needed to comply with a binding requirement. Do not evade a restriction that applies to you through another identity, device, payment method or intermediary. If you believe a decision is based on incorrect information, you may explain that to support. Reviewing a mistake does not allow us to promise a transaction or access that the law prohibits.
Electronic communications and documents
Operational information may be communicated in the app, on the website or through an email exchange you initiate with support. A store may separately send receipts and transaction notices. Keep important offer descriptions, confirmations and correspondence in a form you can refer to. The store's payment record and an answer concerning an app issue may contain different information needed to understand a dispute.
Electronic confirmation may record an agreement or supply notice where legally permitted. Requirements for a retainable copy, individual notice or another specified form still apply. A general website announcement cannot replace particular notice that the law requires for an affected customer. We will use an additional form when it is required for the circumstances.
Service communication does not sign you up for marketing or supply consent to optional tracking. Sending a support message allows handling of the issue within the purposes described in the Privacy Policy, not unrelated reuse or AI training. Creative content included in correspondence, reports or attachments follows the same original deletion deadline as the creation itself.
Support, Utah law and complaint routes
Explain a concern to support@tonyai.org, including an available reference and the outcome you seek, so support can try to resolve it. Provide relevant information without unnecessary private material. You do not have to exhaust an internal support process where the law permits another route, and an exchange with us does not pause a legal deadline.
This agreement and any dispute about it are governed by the laws of the State of Utah, United States, without regard to conflict-of-law rules; our operator is located in Logan, Utah. Protections that cannot be waived under the law where you live continue to apply. This agreement does not appoint an exclusive court, impose mandatory arbitration or require a consumer to give up an available local forum. You remain free to approach a competent consumer authority, privacy authority or court where entitled to do so.
Google Play may have a review route for its transaction decisions. Privacy requests and complaints can use the channels in the Privacy Policy or the competent authority. Preserve the relevant purchase record and correspondence where needed to identify the issue. Using a lawful complaints process is not a breach, and requesting help does not require surrender of an unrelated purchase or privacy right.

The agreement as a whole and any successor
These terms, the relevant feature or purchase conditions and the linked policies describe the service arrangement together. They do not erase legally binding information supplied before a purchase or protected reliance on that information. A privacy notice explains processing and rights; including it among the relevant documents does not convert it into blanket permission to use information.
If one provision is invalid or unenforceable, the remainder applies only to the extent permitted by law. That principle cannot defeat a mandatory right or preserve the effect of a prohibited restriction. A delay in enforcing a condition does not automatically waive the right to address a later breach. Any lawful waiver is limited to the circumstances for which it is given.
Permission to operate or resell the service cannot be transferred without authorisation. If the business or an agreement passes to a successor, existing obligations, privacy requirements and mandatory consumer protections must be respected. Required notices and further steps must be provided. A transfer cannot be used to escape a paid obligation or obtain new, incompatible rights over private creative material.
Revisions and how to reach us
The effective date of this version is November 4, 2026. We may revise the terms as the service, operations or legal requirements change. For material changes, we will provide the notice or obtain the fresh agreement required by law. Editing a webpage alone does not remove an earlier purchase right, authorise a new charge or satisfy a separate consent requirement.
Conditions for a future offer must be available before you choose it. Earlier transactions remain subject to their applicable conditions and mandatory protections. Contact support if you are uncertain which description or version applies, using the reference or correspondence you have. An enquiry about the agreement does not require unrelated personal information or a copy of private creative material.
JTWDBW LLC is the provider, at 335 S 100 W, Logan, UT 84321-5236, United States. Questions about these terms can be sent to support@tonyai.org. The support page covers product issues, purchases, content concerns and privacy enquiries. Our Privacy Policy, AI Data Privacy, Refund Policy and Data Deletion pages explain the relevant handling and request routes.
